Gildage Terms of Service

Effective Date: August 23, 2024

1. Acceptance of Terms

By accessing or using the Gildage website, applications, or services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Services.

2. Definitions

  • "AI Services" refers to the artificial intelligence-powered features and functionalities provided by Gildage, including but not limited to technical support and household-related issue resolution.

  • "User Content" means any data, information, or materials that you provide, generate, or transmit through your use of the Services.

  • “Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  

  • “Third-Party Services” refers to any third-party services, platforms, software, or technologies that Gildage utilizes to provide or support the Services, including but not limited to AI providers, cloud infrastructure providers, and other software-as-a-service (SaaS) providers.  

3. Description of Services

Gildage provides AI-based assistance to seniors through its platform. Currently, the Services include:

  • Technical Support: AI-powered guidance and troubleshooting for common technology issues.

  • Household-Related Issue Resolution: AI-powered assistance with everyday household tasks and challenges.

The scope of Services may expand in the future.

4. User Eligibility

  • You must be at least 18 years old to use the Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.

  • You represent and warrant that all information you provide to Gildage is accurate and complete.

5. Account Creation and Security

  • Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.  

  • If you become aware of any unauthorized access to your account, you must notify Gildage immediately.  

6. Use of Services

  • You agree to use the Services only for lawful purposes and in compliance with these Terms of Service.

  • You may not use the Services in any way that could damage, disable, overburden, or impair Gildage's servers or networks.

  • You agree not to use the Services to:

    • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity  

    • Engage in any activity that is harmful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, or contains explicit or graphic descriptions or accounts of sexual acts  

    • Violate any applicable local, state, national, or international law

7. AI Services & Limitations

  • Gildage utilizes AI technology, including Third-Party Models, to provide assistance. While we strive for accuracy, the AI may have limitations and may not always provide perfect or complete solutions.

  • You acknowledge that relying solely on the AI's output is at your own risk. Gildage is not responsible for any decisions or actions you take based on the AI's responses.

  • The AI Services do not constitute professional advice (e.g., legal, financial, medical). Always seek the guidance of qualified professionals for such matters.

8. User Content & Data Privacy​

  • All data and information generated through your interactions with the AI Services, including but not limited to conversations, queries, and responses, are the sole property of Gildage.

  • Gildage collects and uses data as outlined in our Privacy Policy. By using the Services, you consent to our data practices, including the sharing of your data with Third-Party Services for the purpose of providing and improving the Services.

  • Gildage takes reasonable measures to protect your Personal Information. However, no method of transmission over the Internet or electronic storage is 100% secure.  

9. Third-Party Services

  • Gildage may use Third-Party Services to provide and support the Services. You acknowledge and agree that your use of the Services may involve the use of Third-Party Services, and that Gildage is not responsible for the acts or omissions of any Third-Party Services.

10. Intellectual Property

  • All content and materials on the Gildage platform, including but not limited to text, graphics, logos, images, and software, are the property of Gildage or its licensors and are protected by intellectual property laws.

  • You may not use, reproduce, distribute, or create derivative works of any Gildage content without our prior written consent.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GILDAGE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.  

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILDAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES.  

13. Indemnification

You agree to indemnify and hold Gildage harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of the Services or your breach of these Terms of Service.

14. Termination

Gildage may terminate or suspend your access to the Services at any time, with or without cause, and without notice. Upon termination, your right to use the Services will immediately cease.

15. Modifications

Gildage reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms of Service.  

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California.  

17. Dispute Resolution

Any disputes arising out of or in connection with these Terms of Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
